The Art of Cross Examination
Cross examination is the greatest legal engine ever invented for the discovery of truth. An effective cross examination occurs when art and science meet preparation, tenacity, and skill. In text books, lawyers are taught the following rules to cross examine the opponent:
- Be brief
- Short questions, plain words
- Always ask leading questions
- Don't ask a question you do not already know the answer to
- Listen to the witness' answers
- Don't allow the witness to repeat his direct testimony
- Don't permit the witness to explain his answers
- Don't ask the "one question too many"
The personal injury lawyers at Fineberg Gresham bring this art and skill to a new level. We combine experience, skill, preparation and expertise to effectively cross examine our adversaries thereby extracting admissions to be used to facilitate settlement or prevail at trial. For example, we will critically analyze all of the facts and documents (in one case it was over one million of pages of documents), meet with key witnesses in person, and hire experts who will consult on technical matters. When appropriate, we will meet with our jury consultant who has a PhD in psychology and strategize over technique, approach and execution to maximize the impact of the cross examination.
Our clients have benefited from the skill, preparation, determination and relentless pursuit of justice achieved in our cross-examinations. Our unique process has resulted in hundreds of millions of dollars in total recoveries for our clients.
