Truck Wreck Lawyer Commentary: Innocent Person Killed by Truck Driver Carelessness.
Colorado resident, Lorna Farrow, was hit and killed by a dump truck driver as she checked the mailbox in front of her business, Farrow Repair Service, on July 28. Colorado State Patrol cited the truck driver, James Stackhouse, for careless driving causing death in connection with the crash.
According to a press release issued by the State Patrol, the dump truck driver slammed on his brakes to avoid rear-ending a Jeep that had slowed down in front of him to make a left-turn. Without allowing enough time to react, the truck driver struck and killed Farrow when he over braked and swerved to the right to avoid hitting the Jeep.
Colorado state law specifies that a dump truck or automobile driver may be charged with careless driving when certain conditions are evident. “Any person who drives any motor vehicle, bicycle, or motorized bicycle in a careless and imprudent manner, without due regard for the width, grade, curves, corners, traffic, and use of the streets and highways and all other attendant circumstances.”
Stackhouse will be charged with careless driving, a Class 1 misdemeanor, and will make his first court appearance on October 27. If found guilty of careless driving, he could be punished by a 6 to 18 month prison sentence, a fine ranging from $500 to $5000 dollars, or a combination of incarceration and a monetary fine.
The press release stated that a sergeant who was involved with the truck wreck concluded drugs and alcohol were not considered as contributing factors in the reckless driving truck crash, but rather careless and negligent driving was the likely cause. The particular stretch of highway where the dump truck wreck occurred has been under scrutiny for its safety and officials are considering many possible solutions to improve driving conditions including speed studies, more traffic signage, more traffic law enforcement, wider shoulders and adding a center turn lane.
