On July 5, Melissa Hinkle suffered severe injuries when her Ford Explorer was rear ended by a tractor-trailer driven by Randy Crume and owned by Refrigerated Delivery Services, Inc. based in Tulsa, Oklahoma. Hinkle’s only son, 13-year-old Casey Hinkle, and her father, 63-year-old Gervious Dale Hinkle, were killed in the crash on Interstate 35 near Gainesville, Texas. Burial services were held for the two family members on July 12 in Granbury.

Less than a month later, 3 more people were killed when a tractor-trailer crashed into vehicles stuck in a traffic jam near the site of the Hinkle collision. The stretch of Interstate 35 is under construction for interstate bridgework being performed by KKM Construction, Inc. headquartered in Texarkana, Arkansas. The construction work caused traffic to back up for miles in the case of both deadly tractor-trailer wrecks.

A truck accident attorney filed a wrongful death lawsuit case in Cooke County's 235th District Court in Gainesville on August 6 as Melissa J. Hinkle, et al. v. Randy Crume, et al., No. 09-00364. The wrongful death suit names Randy Crume, the tractor-trailer driver, who according to a Texas state trooper, failed to control his truck’s speed before crashing into Hinkle’s Explorer and several other passenger vehicles. The wrongful death lawsuit also names KKM Construction, Inc. and Refrigerated Delivery Services, Inc., as defendants in addition to Crume and the Texas Department of Transportation (TXDOT).
